Terms and Conditions for the Use of this One Banca Staff Access website (“Service”) by Tokio Marine Life Insurance Malaysia Bhd and Syarikat Takaful Malaysia Keluarga Berhad.

Effective Date: 28 November 2025

1. CONDITIONS OF USE

These Terms and Conditions (“Terms”) govern your access to, and use of the Service provided by Tokio Marine Life Insurance Malaysia Bhd (“TMLM”) and Syarikat Takaful Malaysia Keluarga Berhad (“STMKB”), including their successors and assigns (collectively, the “Company”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms without any limitation or qualification whatsoever.

These Terms may be amended or revised at any time at the sole discretion of the Company, without any prior notice to you. By continuing to use the Service after such amendments, revisions or up-dates are made, you shall be deemed to have agreed to and accepted such amended Terms. You are therefore advised to periodically visit this page to stay informed of the applicable Terms to which you are bound to.

2. DESCRIPTION OF THE SERVICE

The Service is provided solely for RHB Bank staff to access TMLM and STMKB platforms and BancaLearning, Dashboard, and One Chat AI tools. The Service is intended solely for informational and engagement purposes. The Services shall not, in any way, be relied upon or construed as legal, financial, underwriting, or actuarial advice, nor shall it be deemed to constitute a binding offer, decision, or commitment in relation to any insurance/takaful coverage, claims, or issuance of insurance policy/takaful certificate. All final decisions and transactions pertaining to insurance policy/takaful certificate shall be made only by the authorized representatives of the Company.

3. PERMITTED USE OF THE SERVICE

You agree to access and use the Service solely for lawful, informational and engagement purposes. You further agree not to use the Service:

for any harmful or abusive activity, or in a manner that violates applicable laws or regulations or infringes the rights of any other party.
to submit false, misleading, defamatory, or fraudulent information.
to upload, post, or transmit any content that contains viruses, malicious code, or any activity intended to disrupt the Service.
to input any personal health information, social security numbers, payment card details, other personal data, and any confidential company information, or any other data classified as restricted or confidential.

4. ACCESS AND USER RESPONSIBILITIES

Access credentials are strictly personal and non-transferable.
You are solely responsible for maintaining the confidentiality of your login information and for all actions taken under your account.
You shall follow the process provided by the Company in designating the user identification code (the "User ID") and the password (the "Password") for identification purposes.
You shall act in good faith, exercise reasonable care and diligence in keeping your User ID and Password in secrecy. At no time and under no circumstances shall you disclose them to any other person or party.
You shall be fully responsible for any accidental or unauthorised disclosure of your User ID and/or the Password to any person/party and shall bear the risks of your User ID and/or the Password being used by unauthorised persons/parties or for unauthorised purposes.
Any misuse, data manipulation, or breach of confidentiality may result in disciplinary action and/or legal consequences.
You must not attempt to gain unauthorized access to other user accounts or restricted areas of the Service.
You agree to use the Service only for legitimate business purposes in accordance with your role and internal compliance policies.
You acknowledge and agree that these responsibilities and associated risks shall remain with you until the Company suspends or reassigns a new User ID and/or Password to you.
If you suspect that your login information has been compromised, you must immediately notify the Company.

5. INTELLECTUAL PROPERTY

All information published in this Service including those within TMLM and STMKB platforms and BancaLearning, Dashboard, and One Chat AI, shall remain the intellectual property of the Company. You are granted a limited, non-transferable, non-exclusive license to use such content only for its intended purpose and in compliance with these Terms. You shall not copy, reproduce, distribute, or otherwise exploit any content published by this Service without the express written authorisation of the Company.

6. DISCLAIMER OF WARRANTIES

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by law, the Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Company makes no representation or warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components.

The Service is intended for informational and engagement purposes only and may not always reflect the most current policies, terms, or regulatory requirements.

You must verify all information obtained through this Service against official bank resources, product documentation, and approved internal guidelines before communicating it to customers or using it for decision-making.

This Service does not replace official training materials, policy documents, or your professional judgment. Neither the Companies nor the Service developers make any representations or warranties, express or implied, regarding the accuracy or completeness of the information provided, and they are not liable for any errors, omissions, or outcomes resulting from reliance on this Service.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company, its affiliates, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, punitive, special damages, expenses or costs of any kind, howsoever arising as a result of your reliance on, use of or inability to use the Service. You acknowledge and agree that you assume all risks associated with the use of the Service.

8. DATA USE AND PRIVACY

You acknowledge and agree that any data submitted through this Service may be collected, processed, and stored by the Company in accordance with its Privacy Policy/Privacy Notice (Tokio Marine Life Insurance Malaysia Bhd : https://www.tokiomarine.com/my/en/life/privacy-policy.html and Syarikat Takaful Malaysia Keluarga Berhad : https://www.takaful-malaysia.com.my/en/privacy-notice/) and applicable data protection laws and regulations. 9. TERMINATION AND SUSPENSION

The Company reserves the right, at its sole and absolute discretion, to suspend, restrict, or terminate your access to the Service at any time and without prior notice to you, for any reason whatsoever, including but not limited to any actual or alleged violation of these Terms, applicable law, or the Company’s prevailing practices or policies.

10. INFORMATION AND SYSTEM SECURITY

The Company implements appropriate security measures to protect this Service and its supporting systems against unauthorized access, misuse, or disruption. You shall not attempt to circumvent security controls, introduce malicious code, or interfere with it or engage with any malicious activity that may compromise the Service or any other systems within the Company’s environment. While reasonable safeguards are in place, no system is entirely free from risk. By using this Service, you acknowledge and accept that you do so at your own risk and agree to report any suspected security issues or abnormal activity to the Company.

11. ENTIRE AGREEMENT

These Terms, together with the Company’s Privacy Policy/Privacy Notice, constitute the entire agreement between you and the Company with respect to the Service and supersede all prior or contemporaneous communications and understandings.

12. GOVERNING LAW AND JURISDICTION

These Terms shall be governed and construed in accordance with the laws of Malaysia. The Company and you irrevocably and unconditionally agree to submit to the exclusive jurisdiction of the courts of Malaysia. If any provisions of these Terms shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining terms and conditions.

13. USER DECLARATION

By accessing and using the Service, you hereby acknowledge and agree to the following:

You are of legal age and have the legal capacity to enter these Terms.
You are an authorized personnel with legitimate access rights granted by your institution and the respective partners.
You have read, understood, and agree to comply fully with these Terms, the Company’s Privacy Policy, and all internal guidelines governing the use of this Service and its tools, including BancaLearning, Dashboard, and One Chat AI.
You understand that all information, materials, and data available on this Service are confidential and intended solely for internal and authorized business use.
You will not disclose, copy, share, or misuse any information obtained through the Service for personal, external, or unauthorized purposes.
You acknowledge that all activities performed under your user account are your responsibility, and you will always maintain the confidentiality of your login credentials.
You understand that the One Chat AI function provides general assistance and does not constitute official guidance, policy, or advice, and that you must always verify any business decisions against official sources and policies.
You shall not rely solely on the Service for making any insurance/takaful-related decisions and agree to consult directly with a licensed insurance/takaful professional or authorized Company representative as needed.
You agree to comply with all applicable laws, regulations, and codes of conduct as stipulated by TMLM, STMKB, and your employing bank.
You consent to the monitoring and recording of your activities in connection with the Service for security, compliance, and operational purposes.
You acknowledge that any misuse, breach of confidentiality, or violation of these Terms may result in disciplinary action and/or legal proceedings in accordance with the company and employing bank prevailing guidelines or policies, and Malaysian law.

14. LINKED WEBSITES AND THIRD-PARTY CONTENT

The Service may contain links or redirects to:

Official TMLM and STMKB websites;
Tools such as BancaLearning, Dashboard and One Chat AI;

Links from this Service to other websites are meant for your own information and convenience only. Such websites may also be linked to other websites which are owned and maintained by third parties and, as such, are not under the Company’s control. Therefore, we do not assume any responsibility or liability with respect to any of those websites (or any website linking into this website) in any way whatsoever (including their content and operation). Without the express written consent from us, no person, company, or website may link to this Service, whether to its homepage or to any internal page.

Furthermore, the links provided on this website shall not be considered an endorsement, verification or approval of such linked websites or the contents therein.
