Declaration and Terms and Conditions for the Use of One Chat AI services provided by Tokio Marine Life Insurance Malaysia Bhd and Syarikat Takaful Malaysia Keluarga Berhad.

1. CONDITIONS OF USE

These Terms and Conditions (“Terms”) govern your access to, and use of the One Chat AI services (“Service”) provided by Tokio Marine Life Insurance Malaysia Bhd and Syarikat Takaful Malaysia Keluarga Berhad, including their successors and assigns (collectively, the “Company”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms without any limitation or qualification whatsoever.

These Terms may be amended or revised at any time at the sole discretion of the Company, without any prior notice to you. By continuing to use the Service after such amendments, revisions or up-dates are made, you shall be deemed to have agreed to and accepted such amended Terms. You are therefore advised to periodically visit this page to stay informed of the applicable Terms to which you are bound to.

2. DESCRIPTION OF THE SERVICE

The One Chat AI is an automated, interactive platform designed to assist you by providing general information and customer support related to insurance/takaful products and services offered by the Company. The Service is intended solely for informational and engagement purposes. The Services shall not, in any way, be relied upon or construed as legal, financial, underwriting, or actuarial advice, nor shall it be deemed to constitute a binding offer, decision, or commitment in relation to any insurance/takaful coverage, claims, or issuance of insurance policy/takaful certificate. All final decisions and transactions pertaining to insurance policy/takaful certificate shall be made only by the authorized representatives of the Company.

3. PERMITTED USE OF THE SERVICE

You agree to access and use the Service solely for lawful, and informational purposes. You further agree not to use the Service:

  • for any harmful or abusive activity, or in a manner that violates applicable laws or regulations, or infringes the rights of any other party.
  • to submit false, misleading, defamatory, or fraudulent information.
  • to upload, post, or transmit any content that contains viruses, malicious code, or any activity intended to disrupt the Service.
  • to input any personal health information, social security numbers, payment card details, other personal data, and any confidential company information, or any other data classified as restricted or confidential.

You further acknowledge and agree that You are responsible for maintaining the confidentiality of your login credentials, including your user ID and password. You must not share, disclose, or allow others to use Your login credentials under any circumstances. Unauthorized use of login credentials is strictly prohibited and may result in suspension or termination of access to the platform or Service. You are required to notify the Company immediately upon becoming aware of, or suspecting, any unauthorized use of your account or any other breach of security.

4. INTELLECTUAL PROPERTY

All contents generated by One Chat AI, including but not limited to text, images, responses, suggestions and associated trademarks, shall remain the intellectual property of the Company. You are granted a limited, non-transferable, non-exclusive license to use such content for only for its intended purpose and in compliance with these Terms. You shall not copy, reproduce, distribute, or otherwise exploit any content generated by One Chat AI without the express written authorisation of the Company.

5. DISCLAIMER OF WARRANTIES

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by law, the Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. The Company makes no representation or warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components.

The responses generated by this platform are for informational purposes only and may not always reflect the most current policies, terms, or regulatory requirements.

You must verify all information obtained through this Service against official bank resources, product documentation, and approved internal guidelines before communicating it to customers or using it for decision-making.

This Service does not replace official training materials, policy documents, or your professional judgment. The Company does not make any representations or warranties, express or implied, regarding the accuracy or completeness of the responses provided, and is not liable for any errors, omissions, or outcomes resulting from reliance on this tool.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company, its affiliates, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, punitive, special damages, expenses or costs of any kind, howsoever arising as a result of your reliance on, use of or inability to use the Service. You acknowledge and agree that you assume all risks associated with the use of the Service.

7. DATA USE AND PRIVACY

8. TERMINATION AND SUSPENSION

The Company reserves the right, at its sole and absolute discretion, to suspend, restrict, or terminate your access to the Service at any time and without prior notice to you, for any reason whatsoever, including but not limited to any actual or alleged violation of these Terms, applicable law, or the Company’s prevailing practices or policies.

9. INFORMATION AND SYSTEM SECURITY

The Company implements appropriate security measures to protect this Service and its supporting systems against unauthorized access, misuse, or disruption. You shall not attempt to circumvent security controls, introduce malicious code, interfere with the chatbot’s operation, or engage in any malicious activity that may compromise the Service or any other systems within the Company’s environment. While reasonable safeguards are in place, no system is entirely free from risk. By using this Service, you acknowledge and accept that you do so at your own risk and agree to promptly report any suspected security issues or abnormal activity to the Company.

10. ENTIRE AGREEMENT

These Terms, together with the Company’s Privacy Policy, constitute the entire agreement between you and the Company with respect to the Service and supersede all prior or contemporaneous communications and understandings.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed and construed in accordance with the laws of Malaysia. The Company and You irrevocably and unconditionally agree to submit to the exclusive jurisdiction of the courts of Malaysia. If any provisions of these Terms shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining terms and conditions.

12. USER DECLARATION

By accessing and using the Service, you hereby acknowledge and agree to the following:

  • You are of legal age and have the legal capacity to enter into these Terms.
  • You agree to be bound by these Terms and any applicable policies referenced herein.
  • You understand that One Chat AI is an automated platform designed to provide general information regarding insurance/takaful products and services offered by the Company. One Chat AI is not a licensed insurance/takaful agent, broker, underwriter, or financial advisor. The Service is not authorized to bind coverage, approve claims, issue any insurance policy/ takaful certificate, endorsements, or provide definitive coverage determinations.
  • You shall not rely solely on the Service for making any insurance/takaful-related decisions and agree to consult directly with a licensed insurance/takaful professional or authorized Company representative as needed.
